Software Patents are gradually edging their way into EU law (EU Software Patents: The Register) which will almost certainly make the 3D Graphics software development market a huge minefield, with players taking out many patents on 3D technologies which can often be quite fundemental to the operation of the software, small companies could soon find themselves treading very carefully everytime they come up with an idea or locked out of a market if in the natural course of development a new fundemental approach is discovered.

Hope they will not approve this destructive approach.

Will be the end for this little companies as they will have not the financial power to contrast such a *big* who detect a patent for a particular algorithm.(Even if you was the first who invented it...)

But in the oppose this may contribute in some way to the research.
Just take a look at the *in*famous Marching Cubes algorithm (widely used for metaball and scientific visualization for implicit surfaces), scientists worked togheter to find a more reliable and fast solution and they end up with an optimal and *patent-free* algorithm.

But unfortunately this is not always the story...

Again, hope they will evaluate well this situation.

Well, I'm glad that we agree in this opinion. Software patents are the most dangerous thing in software development, not only regarding 3D software. There's an international foundation against software patents, founded in Germany IMHO (not sure about this). More information on:

Software patents in EU will probably not come true, because e.g. Netherlands changed its vote against the patents, and some new countries including Poland opposes it too. Therefore there aren't enough votes to legalize software patents anymore. I'm not aware of the current situation, but this article covers something of it:

Hi, for two years (I think it was for two years) they decided in the EU parlament against software patents. This was done by the pressure of the public and small software companies. And now they try it again!? I think they (parlamentarians) temporarily stop the draft law, but the lobby I think will do all in the future to press through their wishes.
With what they will come next? Patents on mathematics, could be that they want to patent the addition or multiplication? My opinion is that the copyright will be enough to secure the rights of intellectual property. Everybody who has written a computer program in his life knows that some algorithms you use, be standards you can't make better. Nobody reinvents the wheel, as an example. Some dudes think (mean the really big companies) they can takeover the market completly and lock out the smaller one. Modern wars be economic wars. (If you x-ray real wars today, they will be also economic, but with a much higher bodycount, on the battlefield of reality.)

Marching Tetrahedrons was developed to circumvent the Marching Cubes patents.
Btw, the marching cubes patents have expired.

Hi all..

That would be a dangerous road to follow.. and sad if it would come to that.. =(

btw.. isnt this also what has happened on Gens.. ! ?...
Where big companies think they have patents on human gens! and that leads to that no other than who have the patent decides who can use this or that of theirs patented gens..
which leads to no others can research it and therefor cant find cures and so on for deadly diseases.. and so on..

This development is really scary.. =(

And btw.. on most areas.. who can really say they were first with anything?..
Arnt many things just ideas.. that has been partly or mostly copied from what ppl have already done in the past..?
When ever I sit down and play the piano or so.. and wow I find a new tune of mine. which grows as time go.. but can I really be sure that none ever have played this tune or part of it before?

Some ppl are more inventive and skilled than others.. but hey.. I doubt that too many ideas now adays are truly genuinely new ones..=)
